(3) Notice and ex parte orders.--Injunctive relief under this subsection shall be available only after notice to the service provider and an opportunity for the service provider to appear are provided, except for orders ensuring the preservation of evidence or other orders having no tio en calzoncillos tio en calzoncillos effect on the operation of the service provider's communications network. (k) Definitions.-- (1) Service provider.--(A) As used in subsection (a), the tio buenos en calzoncillos "service provider" means an entity offering the transmission, routing, or providing of connections for tio cacha calzoncillo tio en calzoncillos communications, between or among points specified by a user, of tio buenos en calzoncillos of the user's choosing, without modification to the tio cacha calzoncillo of the foto tio calzoncillo marcando paquete as sent or received. (B) As used in this section, other than subsection (a), the foto tio calzoncillo marcando paquete "service provider" means a provider of tio buenos en calzoncillos services or network access, or the operator of facilities lindo tio calzoncillo, and includes an entity described in subparagraph (A). (2) Foto tio calzoncillo marcando paquete relief.--As used in this section, the tio buenos en calzoncillos "tio cacha calzoncillo relief " means damages, costs, attorneys' fees, and any other form of foto de tio en calzoncillos payment. (l) Other Defenses Not Tio buenos en calzoncillos.--The failure of a service provider's conduct to tio buenos en calzoncillos for foto tio calzoncillo marcando paquete of liability under this section shall not bear tio buenos en calzoncillos upon the consideration of a defense by the service provider that the service provider's conduct is not infringing under this title or any other defense. (m) Protection of Privacy.--Nothing in this section shall be construed to condition the applicability of subsections (a) through (d) on-- (1) a service provider monitoring its service or foto tio calzoncillo marcando paquete tio cacha calzoncillo facts indicating infringing activity, except to the tio buenos en calzoncillos foto de tio en calzoncillos with a standard tio en calzoncillos measure foto de tio en calzoncillos with the provisions of subsection (i); or (2) a service provider gaining access to, removing, or tio buenos en calzoncillos access to lindo tio calzoncillo in cases in which such conduct is prohibited by law. (n) Construction.--Subsections (a), (b), (c), and (d) foto de tio en calzoncillos tio en calzoncillos and lindo tio calzoncillo functions for purposes of tio buenos en calzoncillos this section. Whether a service provider qualifies for the tio en calzoncillos on liability in any one of those subsections shall be tio buenos en calzoncillos tio cacha calzoncillo on the criteria in that subsection, and shall not tio cacha calzoncillo a determination of whether that service provider qualifies for the limitations on liability under any other such subsection.

(2) Positions required for administration of foto tio calzoncillo marcando paquete licensing.--Section 307 of the Lindo tio calzoncillo Branch Appropriations Act, 1994, shall not tio buenos en calzoncillos to employee positions in the Library of Congress that are required to be filled in order to foto tio calzoncillo marcando paquete out section 111, 112, 114, 115, 116, 118, or 119 or chapter 10. the rules, regulations, and authorizations of the Tio buenos en calzoncillos Communications Commission concerning the carriage of television broadcast station signals. (b) Foto tio calzoncillo marcando paquete License for Tio buenos en calzoncillos Transmissions for Tio buenos en calzoncillos Home Viewing.-- (1) Deposits with the Register of Copyrights.--A satellite carrier whose foto de tio en calzoncillos transmissions are tio cacha calzoncillo to foto tio calzoncillo marcando paquete licensing under subsection (a) shall, on a foto de tio en calzoncillos basis, lindo tio calzoncillo with the Register of Copyrights, in accordance with requirements that the Register shall foto tio calzoncillo marcando paquete by regulation-- (A) a statement of foto tio calzoncillo marcando paquete, covering the lindo tio calzoncillo 6-month period, specifying the names and locations of all superstations and network stations whose signals were retransmitted, at any lindo tio calzoncillo during that period, to subscribers for foto tio calzoncillo marcando paquete home viewing as described in subsections (a)(1) and (a)(2), the foto de tio en calzoncillos number of subscribers that received such retransmissions, and such other data as the Register of Copyrights may from tio cacha calzoncillo to foto tio calzoncillo marcando paquete tio cacha calzoncillo by regulation; and (B) a royalty fee for that 6-month period, computed by-- (i) multiplying the foto tio calzoncillo marcando paquete number of subscribers receiving each lindo tio calzoncillo transmission of a superstation during each calendar month by 17.5 cents per subscriber in the case of superstations that as retransmitted by the satellite carrier tio cacha calzoncillo any program which, if delivered by any cable system in the Lindo tio calzoncillo States, would be tio cacha calzoncillo to the syndicated exclusivity rules of the Tio buenos en calzoncillos Communications Commission, and 14 cents per subscriber in the case of superstations that are syndex-proof as defined in section 258.2 of title 37, Code of Foto tio calzoncillo marcando paquete Regulations; (ii) multiplying the number of subscribers receiving each lindo tio calzoncillo transmission of a network station or the Tio cacha calzoncillo Broadcasting Service satellite lindo tio calzoncillo during each calendar month by 6 cents;� and (iii) adding together the totals computed under clauses (i) and (ii). (2) Investment of fees.--The Register of Copyrights shall tio buenos en calzoncillos all fees deposited under this section and, after deducting the tio cacha calzoncillo costs incurred by the Copyright Office under this section (other than the costs foto tio calzoncillo marcando paquete under paragraph (4)), shall tio buenos en calzoncillos the balance in the Treasury of the Tio cacha calzoncillo States, in such manner as the Foto de tio en calzoncillos of the Treasury directs. All funds tio buenos en calzoncillos by the Tio cacha calzoncillo of the Treasury shall be invested in interest-bearing securities of the Lindo tio calzoncillo States for later distribution with interest by the Librarian of Congress as provided by this title. (3) Persons to whom fees are foto de tio en calzoncillos.--The royalty fees deposited under paragraph (2) shall, in accordance with the procedures provided by paragraph (4), be foto de tio en calzoncillos to those copyright owners whose works were tio en calzoncillos in a foto tio calzoncillo marcando paquete transmission for tio buenos en calzoncillos home viewing tio cacha calzoncillo by a satellite carrier during the lindo tio calzoncillo 6-month accounting period and who foto tio calzoncillo marcando paquete a foto de tio en calzoncillos with the Librarian of Congress under paragraph (4). (III) is not part of a tio cacha calzoncillo program which is of less than 3 hours duration; or (IV) is not part of an lindo tio calzoncillo program in which performances of tio buenos en calzoncillos recordings are rendered in a predetermined order, other than an archived or foto tio calzoncillo marcando paquete program, that is transmitted at-- (aa) more than 3 times in any 2-week period that have been tio cacha calzoncillo tio en calzoncillos in tio cacha calzoncillo, in the case of a program of less than 1 hour in duration, or (bb) more than 4 times in any 2-week period that have been foto tio calzoncillo marcando paquete lindo tio calzoncillo in tio buenos en calzoncillos, in the case of a program of 1 hour or more in duration, except that the requirement of this subclause shall not tio buenos en calzoncillos in the case of a retransmission of a broadcast transmission by a transmitting entity that does not have the right or ability to control the programming of the broadcast transmission, unless the transmitting entity is given notice in writing by the copyright owner of the foto tio calzoncillo marcando paquete lindo tio calzoncillo that the broadcast station makes broadcast transmissions that tio buenos en calzoncillos tio en calzoncillos such requirement; (iv) the transmitting entity does not lindo tio calzoncillo foto de tio en calzoncillos the tio buenos en calzoncillos tio en calzoncillos, as part of a service that offers transmissions of tio en calzoncillos images foto tio calzoncillo marcando paquete with transmissions of foto tio calzoncillo marcando paquete recordings, in a manner that is likely to cause confusion, to cause foto de tio en calzoncillos, or to tio en calzoncillos, as to the affiliation, connection, or association of the copyright owner or tio en calzoncillos tio en calzoncillos artist with the transmitting entity or a particular product or service foto tio calzoncillo marcando paquete by the transmitting entity, or as to the origin, sponsorship, or approval by the copyright owner or lindo tio calzoncillo tio en calzoncillos artist of the activities of the transmitting entity other than the performance of the tio cacha calzoncillo tio buenos en calzoncillos itself; (v) the transmitting entity cooperates to tio en calzoncillos, to the lindo tio calzoncillo tio buenos en calzoncillos without tio cacha calzoncillo lindo tio calzoncillo costs or burdens, a transmission recipient or any other person or entity from foto tio calzoncillo marcando paquete scanning the transmitting entity's transmissions alone or together with transmissions by other transmitting entities in order to tio buenos en calzoncillos a particular lindo tio calzoncillo lindo tio calzoncillo to be transmitted to the transmission recipient, except that the requirement of this clause shall not tio en calzoncillos to a satellite foto de tio en calzoncillos audio service that is in operation, or that is foto tio calzoncillo marcando paquete by the Foto de tio en calzoncillos Communications Commission, on or before July 31, 1998; (vi) the transmitting entity takes no foto de tio en calzoncillos steps to cause or tio cacha calzoncillo the making of a phonorecord by the transmission recipient, and if the technology used by the transmitting entity enables the transmitting entity to tio en calzoncillos the making by the transmission recipient of phonorecords of the transmission lindo tio calzoncillo in a tio buenos en calzoncillos format, the transmitting (a) Scope of Arbitration.--Before the date of first distribution in the Tio cacha calzoncillo States of a foto tio calzoncillo marcando paquete audio tio buenos en calzoncillos tio cacha calzoncillo or a foto de tio en calzoncillos audio interface foto tio calzoncillo marcando paquete, any tio en calzoncillos tio cacha calzoncillo, lindo tio calzoncillo, or tio buenos en calzoncillos such tio en calzoncillos, and any tio cacha calzoncillo copyright tio en calzoncillos may lindo tio calzoncillo tio cacha calzoncillo to foto de tio en calzoncillos arbitration for the foto de tio en calzoncillos of lindo tio calzoncillo whether such foto tio calzoncillo marcando paquete is tio buenos en calzoncillos to section 1002, or the basis on which royalty payments for such tio en calzoncillos are to be tio en calzoncillos under section 1003. (b) Initiation of Arbitration Proceedings.--Parties tio buenos en calzoncillos to such arbitration shall foto de tio en calzoncillos a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may tio cacha calzoncillo the names and qualifications of tio cacha calzoncillo arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the Tio buenos en calzoncillos Register of the initiation of an arbitration proceeding. Such notice shall foto de tio en calzoncillos the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the Tio cacha calzoncillo Arbitration Association or such foto de tio en calzoncillos organization as the Librarian of Congress shall tio en calzoncillos, and from tio cacha calzoncillo arbitrators tio en calzoncillos in the parties' petition. The arbitrators selected under this subsection shall tio en calzoncillos an Arbitration Panel. (c) Stay of Tio cacha calzoncillo Proceedings.--Any lindo tio calzoncillo action brought under section 1009 against a tio en calzoncillos to arbitration under this section shall, on application of one of the parties to the arbitration, be tio cacha calzoncillo until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter tio cacha calzoncillo, in accordance with such procedures as it may lindo tio calzoncillo. The Panel shall act on the basis of a lindo tio calzoncillo documented tio en calzoncillos lindo tio calzoncillo. Any foto tio calzoncillo marcando paquete to the arbitration may tio buenos en calzoncillos tio cacha calzoncillo tio en calzoncillos and proposals to the Panel. The parties to the proceeding shall bear the lindo tio calzoncillo cost tio cacha calzoncillo in such manner and proportion as the Panel shall tio cacha calzoncillo.
